1. Parent or guardian acceptance
These Terms of Use (“Terms”) apply to the Charmed Chronicles website and learning service. Because the service is designed for young children, an adult parent or legal guardian must review and accept these Terms and supervise the child's use.
By accessing or allowing a child to use the service, you represent that you are legally able to agree to these Terms. If you do not agree, do not use or permit use of the service.
2. The learning service
Charmed Chronicles provides games and activities intended to support preschool and kindergarten-preparation practice. Features may include reading, math, matching, memory, patterns, coloring, rewards, goals, and parent-facing progress information.
The service is a supplemental learning activity. It is not a school, accredited educational program, childcare provider, medical service, diagnostic tool, or substitute for professional educational, developmental, medical, or psychological advice.
3. Access and family responsibility
The current version uses an approved grown-up email as a private family access gate. Parents and guardians are responsible for:
- controlling access to approved email addresses and devices;
- supervising child use and making age-appropriate choices;
- keeping browser profiles and device access reasonably secure;
- reviewing parent settings and any information entered into custom fields; and
- telling us promptly about suspected unauthorized access or misuse.
The current email allowlist is a convenience for private access and is not a substitute for a full account-security system.
4. Permission to use the service
Subject to these Terms, we grant families a limited, personal, non-exclusive, non-transferable, revocable permission to use the service for private, noncommercial learning and evaluation. No ownership rights are transferred.
5. Acceptable use
You agree not to:
- use the service for unlawful, harmful, abusive, or commercial exploitation;
- attempt to bypass access controls or interfere with service operation or security;
- probe, scan, scrape, reverse engineer, or overload the service except where applicable law expressly permits the activity;
- upload or enter malicious code, unlawful content, or another person's data; or
- copy, sell, sublicense, or redistribute protected service content without permission.
6. Family-entered content and device data
Parents may enter custom words or goals and may save coloring artwork. You are responsible for the content entered and confirm that you have the right to use it. Do not enter sensitive personal information or content that infringes another person's rights.
The current version saves this material and learning progress in the browser. Clearing browser data, changing devices, using private browsing, or a browser failure may erase it. Families should not rely on the service as the only copy of important material.
7. Ownership
The service software, design, branding, learning materials, graphics, and other content are owned by or licensed to Charmed Chronicles and are protected by applicable intellectual-property laws. Family-entered content remains the family's content, subject to the limited technical use needed to display and operate it.
8. Third-party services and links
The hosted service depends on third parties such as Vercel and Google Analytics. Links to third-party sites are provided for convenience. Their services, availability, terms, and privacy practices are controlled by those third parties, not by Charmed Chronicles.
9. Changes, availability, and ending access
We may improve, change, suspend, or discontinue any feature or the service as a whole. We may restrict access when reasonably necessary for security, maintenance, legal compliance, or violation of these Terms. We do not promise that the service will always be available, error-free, or compatible with every device or browser.
10. Disclaimers
To the fullest extent permitted by applicable law, the service is provided “as is” and “as available.” We disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not guarantee any particular learning outcome, school-readiness result, skill assessment, progress score, or developmental result. Parents and guardians remain responsible for decisions about a child's education, care, and wellbeing.
11. Limitation of liability
To the fullest extent permitted by applicable law, Charmed Chronicles will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, progress, access, opportunity, or profits arising from use of or inability to use the service.
Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of this section may not apply. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.
12. Changes and contact
We may update these Terms as the service changes. The effective date at the top identifies the latest version. Material changes will be presented in a reasonably noticeable way. Continued use after an updated version takes effect means the supervising adult accepts the revised Terms.
